What the NAR?!

Do I need to update my existing listing agreement?

Yes.
You'll need to amend your current listing agreement to remove any references to offers of compensation and include the new required disclosures.

Alternatively, you can switch to the updated Florida Realtors version of the listing agreement.

How will I find offers of compensation now that it won’t be in the MLS?

You'll need to directly contact the listing agent or check their website to see if they are offering any compensation to buyer agents.

This information can then be shared off-MLS during negotiations.

How the MLS is enforcing new changes.

It's a self-reporting system, so other agents can notify the MLS if they suspect an agent is not using the required written agreements. The agent will then have a grace period to provide a copy before potential fines are assessed

  1. Prohibited keywords and phrases are blocked from being entered into the MLS

  2. Flagging of potential violations for staff review and issuance of warnings/fines

  3. Agents required to provide written buyer agreements upon request, or face penalties

The policy changes agreed to by NAR include:

How will buyer's agents get paid now?

Compensation will continue to be negotiable between agents and their clients. Options may include:

The key is transparent negotiation and representation of the consumer's best interests.

How will the new compensation rules be enforced?
